A.
Fair Use
A
Course in Miracles® contains many ideas that belong to the body of
universal spiritual truths, and are not specific to the Course
itself. The Foundation has no desire to control any ideas contained
in A Course in Miracles®. Its concepts can, of course, be discussed
independently of the Course. The Foundation's rights as a copyright
holder, however, require that others respect, and not infringe, the
copyrighted expression in A Course in Miracles® of those ideas.
Direct quotation. copying, excerpting, close paraphrasing, adapting,
and publishing a work, or a portion of a work, without permission is
an infringement, unless the use is considered a "Fair
Use." Bear in mind that Fair Use, which is found in Section 107
of the Copyright Act, is a defense to copyright infringement.
Authors
may quote (or closely paraphrase) up to 300 words of prose from A
Course in Miracles" and our related publications (written,
audio, video, internet, etc.), other than newsletter articles,
either in one quote or cumulatively, in their own news articles,
books, scholarly journals, research papers, audio/visual works, or
internet material, and for personal/individual use, without written
permission, if all of the following criteria are met (the same
policy holds for quotations from Foundation articles, except that
these citations may not exceed 150 words):

The 300/150 words do not constitute a complete unit, such as an
article, chapter, sub-chapter, lesson, or verse. With respect to the
poetry in The Gifts of God, up to l0% or ten lines, whichever is
less, may be used without permission. However, permission is
required for the use of a complete literary unit of any poem (verse
or stanza) regardless of length.
2.
The 300/150 words account for not more than 10% of the text of the
work in which they are quoted.
3.
The 300/150 words are used to illustrate or support the author's own
text. (Permission is required for use of every quotation of any
length used in an anthology, collective work, or adaptation.)
4.
The 300/150 words are not used for purposes of advertising or
promotion, or to sell products or commercial services.
5.
Proper copyright and trademark acknowledgment is given.

Citations
and References
In accordance with standard publishing practice, paraphrases or
quotes from Course materials should be properly noted in an author's
work. Citations and references to Course materials are to follow the
material, or appear as a footnote, end note, or parenthetical
reference in the text, keyed to a bibliography or list of sources.
If page numbers are used in references, they should be followed by
the edition of the Course which is being cited, i.e., either 1st or
2nd edition.
EXAMPLES
of a proper reference or citation for quotation:
"You
have but two emotions, love and fear" (Text, p. 230, 1st
edition).
"You
have but two emotions, love and fear" (Text, p. 247, 2nd
edition).
Alternative
method for 2nd edition: "You have but two emotions, love and
fear" (T-13.V. 1: I). EXAMPLES of a proper reference or

Accuracy
All
quotations should be completely accurate, including all appropriate
punctuation, capitalization, etc., in the original text, unless
specifically approved to the contrary prior to publication.
Note:
Works may not be identified as "Based upon A Course in Miracles®."
They may be identified as "Inspired by A Course in Miracles®."
If
the use of A Course in Miracles®, or other Foundation publication,
exceeds these guidelines, permission that has been granted to use
those materials shall end. Further public distribution of those
materials shall then be considered an infringing use, subject to all
of the rights and remedies afforded copyright owners under the
Copyright Act.
Important:
The above 300/150 word guidelines apply to either a single quotation
of 300/150 words or to several shorter quotations that together
comprise 300 words.

Conditions Requiring Prior Permission*
1.Works
seeking to quote a complete unit, such as an article, chapter,
sub-chapter, poem, lesson, verse, or
2.Where
the 300/150 words account for more than 10% of the text of the work
in which they are quoted, or
3.If
several short, non-consecutive quotations from one source add up to
more than 300/150 words all together, or
4.Works
in which the quotations are used as the main or only text of the
work, or to provide editorial comment on a visual item, or
6.
The quotation will appear in any amount of advertising, promotional,
commercial materials, or products for sale, or
7.
A quotation of any length will be used in an anthology, collective
work, or adaptation.
*Exceptions
to the amount of material permitted to be quoted may be made only if
authors demonstrate to the sole satisfaction of the Foundation that
they cannot adequately present or substantiate a critical argument
without occasional longer quotations.

Information
Needed to Consider Requests
When writing, the following information (in English) must be
included in order to prevent delays in processing requests:

Title of the book/periodical/journal in which quoted material will
appear
· Full name of author/organization
· Full mailing address of author/organization
· Exact portions to be quoted (include word count and page
number)
· Percentage of quoted material in relation to the overall work
in which it is to appear
· Length of work (number of words, number of pages, etc.)
· Materials to be included in author's work such as
illustrations, if they comprise a significant portion
of the work
· Publisher of work
· Tentative publication or on-sale date
· The purpose and distribution medium in which those portions are
quoted: e.g.. bookstores. newsletters, on-line
· Format/medium (e.g., trade paperback, internet newsletter)
· Initial print run (number of copies) or circulation (in case of
a periodical)
· Tentative retail price
· Exact rights requested (reprint, North American,
English-language)
· A self-addressed stamped envelope
· A copy of the work (If the work is in a language other than
English, an English translation must be submitted as well)

Fees
Permission
to quote will be evaluated and, if granted, a modest fee or
reasonable royalty for such use may be requested along with the
return of signed permission forms. Where permission fees are
charged, they are due upon publication of your work. Accompanying
your payment, if required, should be one copy of your work.
Fees
will be determined on the basis of (1) the amount and nature of the
material to be quoted in relation to the amount of total material in
the work; (2) the nature (commercial, non-commercial, academic,
etc.) of the requested use; and (3) the anticipated printing or
circulation.
Failure to publish requested materials within two years of the issue
date of a permission contract/agreement shall constitute termination
of the contract/agreement, except as otherwise provided in any
written permission contract/agreement.
Classroom Use*
Photocopying
of limited portions of the Course material by teachers for use in
college or university classes-- when teachers and students are in
the same physical location -- is allowed under the conditions stated
below. This permission does not apply to internet classes,
correspondence courses, and the like.

Single Copies For Teachers
A
single copy may be made of any of the following, by or for teachers
at their individual request for their scholarly research or use in
teaching or preparation to teach a class:

A section from A Course in Miracles" or any other Foundation
book
B. A Foundation article from one of the Foundation's periodicals
C. An essay or poem
D. A chart, graph, diagram, drawing or picture from a Foundation
book, periodical, or tape album

Multiple Copies for Classroom Use
Multiple
copies of A, B, C. D above (not to exceed in any event more than one
copy per pupil in a course) may be made by or for the teacher giving
the course for classroom use or discussion, provided the copying
meets the following tests of spontaneity and cumulative effect. Each
copy must also include prominent notice that it is copyrighted
material.
1.
Spontaneity
The
copying is at the instance and inspiration of the individual
instructor, and the inspiration and decision to use the work and the
moment of its use for maximum teaching effectiveness are so close in
time that it would be unreasonable to expect a timely reply to a
request for permission.
2.
Cumulative Effect
The
copying of the material is for only one course in the school or
institution in which copies are made.
Not
more than one poem, article, or three excerpts from any of the
Foundation's printed materials may be copied during a six-month
period.
Copying shall not be used to create or replace anthologies,
compilations or collective works. There shall be no copying of works
intended to be consumable, such as course workbooks, test booklets,
etc. No charge shall be made to the student beyond the actual cost
of copying. Copying shall not substitute for the purchase of books,
reprints, or periodicals; be directed by a higher authority, or be
repeated with respect to the same item by the same teacher from term
to term.
*The
Classroom Use Guidelines reprinted above, with some editorial
changes, was authored by representatives of the educational
community and publishers in 1976 and made part of the Congressional
Record. They have been agreed to by the Association of American
Publishers and the Authors' League of America. |
